1. Acceptance of Terms

By accessing or using GateBeacon (the "Service"), a product of Gatebeacon ("Company," "we," "us," or "our"), you ("User" or "you") agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms apply to all visitors, registered users, and anyone else who accesses the Service. We reserve the right to update these Terms at any time. Continued use of the Service after any modification constitutes acceptance of the revised Terms.

2. Description of Service

GateBeacon is a subscription-based platform that enables users to publish self-hosted applications running on their own hardware to the public internet via a secure managed connection. The Service includes device enrollment, application deployment, domain management, SSL certificate provisioning, and related support features (collectively, the "Service").

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding agreement.

4. User Accounts

To access the Service, you must register for an account. You agree to provide accurate, complete, and current information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must notify us immediately at info@gatebeacon.com of any unauthorized use of your account or any other security breach. We are not liable for any loss or damage arising from your failure to protect your account.

5. Subscriptions and Payment

GateBeacon offers subscription plans billed on a monthly or annual basis. All prices are displayed in Indian Rupees (INR). GateBeacon is not currently registered under GST; applicable GST rate is 0%.

Payments are processed securely through Razorpay. By providing payment details, you authorize us to charge the applicable subscription fee to your chosen payment method on a recurring basis until you cancel.

Subscription fees are non-transferable and non-exchangeable. Failure to pay may result in suspension or termination of your account.

6. Free Trial

New users may be eligible for a free trial period of up to 7 days with access to Premium features. No payment method is required to start the trial. At the end of the trial period, if you have not selected and paid for a Standard or Premium subscription, your account automatically moves to the free Community plan described in Section 6A, rather than losing access outright. If your device or application usage during the trial exceeds the Community plan's limits, the Service continues operating within those limits (for example, the earliest device or application you set up keeps working) rather than shutting down entirely; the remainder stay associated with your account but do not receive public traffic unless you remove enough of them or upgrade to a paid plan. We reserve the right to modify or discontinue the trial offer at any time.

6A. Community Plan

GateBeacon may offer a free "Community" plan alongside its paid Standard and Premium subscription plans, available from account creation or after a free trial period ends. The Community plan requires no payment method and carries no subscription fee. It is limited to one (1) enrolled device per account, one (1) published application at any given time, and a bandwidth allocation intended for light, personal use that is lower than the allocation provided under paid plans. A user may move to a paid Standard or Premium plan at any time to remove these limits, subject to the terms of that plan. As with other components of the Service described in Section 2, GateBeacon may adjust the scope of the Community plan from time to time, and if GateBeacon discontinues the Community plan, or discontinues free usage of the Service generally, it will provide at least two (2) months' advance notice through the customer portal or the email address on file before doing so.

7. Cancellation and Refunds

You may cancel your subscription at any time from the billing section of your account. Please refer to our Refund and Cancellation Policy for complete details on refund eligibility and the process.

8. Acceptable Use

You agree not to use the Service, including any device, application, or public domain published through the Service, to:

• Host, distribute, transmit, or link to illegal content, or content that is restricted or prohibited under applicable local, national, or international law.
• Host or distribute content that exploits, endangers, sexualizes, or otherwise victimizes minors.
• Host or distribute content that facilitates human trafficking, forced labor, slavery, or any other conduct that violates the fundamental human rights or dignity of any person.
• Host or distribute content that incites or threatens violence, promotes terrorism, or constitutes hate speech directed at an individual or group.
• Violate any applicable local, national, or international law or regulation.
• Infringe upon the intellectual property rights of others.
• Transmit malware, viruses, or other harmful code.
• Interfere with or disrupt the Service or servers connected to the Service.
• Attempt unauthorized access to any part of the Service or its infrastructure.
• Resell or sublicense the Service without our prior written consent.

Enforcement. GateBeacon reserves the right, at its sole discretion and without prior notice, to investigate any device, application, or public domain published through the Service, and to immediately remove, suspend, retire, or revoke enrollment for any device, application, or domain that we reasonably believe hosts or distributes content in violation of this Acceptable Use Policy. We may take this action in addition to, or instead of, suspending or terminating the associated account.

No refunds following enforcement. If GateBeacon removes a domain, application, or device enrollment under this section, no refund — full or partial, pro-rated or otherwise — is issued for subscription fees already paid, whether attributable to the removed domain, application, or device or otherwise. This is consistent with the general Refund and Cancellation Policy referenced in Section 7, and does not limit any other remedy available to GateBeacon, including reporting unlawful content to the relevant authorities.

We reserve the right to suspend or terminate accounts that violate these acceptable use obligations without prior notice.

8A. Device Enrollment Acknowledgment

Before enrolling any device into GateBeacon, you must expressly accept this Acceptable Use Policy through the confirmation step presented in the customer portal enrollment wizard. Acceptance is required for every new device enrollment token and is recorded, together with the version of this policy you accepted and a timestamp, against that enrollment. You may not enroll a device, and GateBeacon will not issue an enrollment token or installation command, until this acknowledgment has been given.

9. Intellectual Property

All content, software, trademarks, logos, and other intellectual property associated with GateBeacon are the exclusive property of Gatebeacon or its licensors. Nothing in these Terms grants you any right to use our intellectual property without our prior written consent.

You retain full ownership of any data, content, or applications hosted through the Service. By using the Service, you grant us a limited, non-exclusive licence to process your data solely for the purpose of providing the Service.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Gatebeacon and its directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

In no event shall our total liability to you exceed the amount paid by you to us in the three (3) months immediately preceding the event giving rise to the claim.

13. Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach these Terms or if we determine, in our sole discretion, that your use of the Service is harmful to us, other users, or third parties. Upon termination, your right to use the Service ceases immediately.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.
